Similar to a contested divorce, uncontested divorces must cite legitimate grounds to fulfill New York’s requirement to start the proceedings. Grounds are the guidelines that detail the reason someone seeks a divorce.  These can include:

  • Irreconcilable differences for at least 6 months
  • Adultery
  • Cruelty
  • Abandonment
  • Incarceration in jail or mental facility for 3 consecutive years

New York was one of the last states to write legislation for a “no-fault” divorce. “No-fault” divorce means that grounds need to be cited, not proven.
