The Family Court Act allows for a singular court system of judges and support magistrates to take cases related to the family and the authority to uphold the law. Family Court is similar to the other courts in the Unified Court System in many ways, but there are a few differences. A judge or a support magistrate will hear your case.  Family Courts do not have juries, so verdict for cases lie solely on the case’s authority figure. Another difference between family and other courts is that the records of family court are not open to the public.

Nassau and Suffolk County Family Courts also hear and judge cases that are not so ordinary. These cases can include:

  • Juvenile delinquency
  • Domestic violence
  • Persons in need of supervision

Though criminal courts often hear cases of domestic violence, New York defines family offenses to include only those related by blood or legal marriage. Family Court does not have jurisdiction over divorces. Divorces must be litigated in Supreme Court.

What to expect in Long Island Family Court

Family Court is similar to other courts. Family Court is generally open to the public. Every case is identified with a docket number. Parties who have been scheduled to appear in court are expected to arrive on time. If a person is not present when a case is called, the judge or support magistrate can decide on the case in their absence, except in cases with active military personnel. When the court passes judgment, parties have the right to appeal. Family Court offers childcare to assist parents and guardians who are required to appear in court.
