  • Unlike child support, which is a statutory mandate, the payment of college expenses is not mandated by the law.
  • Most people address this issue unless the children are infants at the time of divorce and leave that issue for the future.
  • Sometimes it will be 50/50, sometimes pro rata based upon the respective parties’ incomes or other scenarios.
  • Sometimes the parties agree to cap the expenses to what we call a SUNY (State University of New York) caps, so that neither party is obligated to pay more than their share of what it would cost to put the child through a SUNY education.
