What is a motion?

  • A motion is a set of papers that either party can file with the court and serve on the other side during the course of the divorce.
  • Usually this is asking the court for some kind of relief, or assistance.
  • Those orders may impact, for example, temporary custody of children, temporary child support, and an order for the spouse who generally paid the bills or was responsible to pay the bills to continue to pay these bills during the course of the litigation.
  • This becomes important when one spouse is dependant upon the other, and they decide to stop paying, which can create a financial hardship and an emergency situation that has to be addressed.
